In July, the SEC approved amendments to Rule G-40, on e-mail
contacts, and Form G-40.[1] The amendments require that every dealer maintain
an Internet e-mail account to permit communication with the MSRB, and that all
Form G-40 submissions – initial forms and subsequent updates and amendments –
be completed electronically using the appropriate user ID and password.[2] The information on Form G-40 includes the
Primary Contact’s name, e-mail address and telephone number. In addition, within 17 business days after
the end of each calendar quarter, dealers
are now required to review and either electronically update information on
their Primary Contact or indicate that no changes are necessary at this time.[3]
The MSRB is publishing this one-time notice as a reminder that
by October 26, 2005 every
dealer must review and either update its Form G-40 or affirmatively indicate
that no changes are necessary.[4] For additional guidance with this process,
please refer to the Qs & As published in MSRB Notice 2005-40 on August 8, 2005.

required to resubmit their initial Form G-40 electronically.

non-compliance with Rule G-40, which the MSRB will refer to the NASD (or other
appropriate regulatory agency).

future reminder notices regarding the quarterly review requirement; dealers are
responsible for ensuring that they comply with this requirement within the time
frame specified by Rule G-40.
